Julia Hejazi, Rockingham County’s chief assistant district attorney, said felony breaking and entering and larceny charges would be dropped against McIrvin if he agrees to the terms set forth by a deferred prosecution deal Thursday in district court. McIrvin, 43, turned himself in to police July 13, about a week after the former Rockingham County Animal Shelter volunteer removed the cats from the facility to help them avoid euthanasia. He later paid the veterinary hospital a discounted $100 adoption fee for each cat and a week’s worth of board. All 37 cats were adopted.
