A woman who struck and killed a teen with her SUV over a year ago in Ontario, Canada, is suing the victim's family for more than $1 million, attorneys said Friday.

Brandon Majewski, 17, died after he and two of his friends were hit while riding bikes in the early morning hours of Oct. 28, 2012, reported Canada's CTV News.

SUV driver Sharlene Simon claimed she didn't see the boys in the dark, and police did not charge her after they found no wrong-doing on her part, her lawyer, Michael Ellis, said in a statement.

Majewski's parent's recently learned Simon is seeking $1.35 million in damages "for the ‘pain and suffering’ she sustained after taking the teen’s life," family lawyer Brian Cameron said in a statement.

Simon is also suing the families of the other two boys she struck and the County of Simcoe, where the accident occurred, CTV News reported.

Ellis said that his client is also a "victim."

"Ms. Simon has been unable to return to work since the collision," Ellis said. "She relives the terror of this incident every day."

But the teenager's parents are devastated by Simon's actions.

"She says she’s in pain? Tell her to look inside my head and she will see pain, she will see panic, she will see nightmares,” said Brandon’s mother, Venetta Mlynczyk, according to the Toronto Sun.

The boy's family also filed suit against Simon shortly after the accident, Ellis said.
