The NBC10 Boston Investigators are uncovering new details about the lone holdout juror from the Lindsay Clancy murder trial.

Court documents and interviews with family members reveal a history of domestic violence allegations. We discovered a pending eviction case tied to months of not paying rent.

The NBC10 Boston Investigators also found an active restraining order against him, while he was listening to evidence in the case.

Those details raise questions about the jury selection process and how the Plymouth County resident was picked for the high-profile case that ended in a mistrial.

NBC10 Boston has repeatedly attempted to contact the juror at home, where his landlord is currently trying to evict him.

We are not identifying him at this time because he has chosen not to speak publicly and the jury list is currently impounded. However, we wanted to share the details that experts say should have raised red flags about how he filled out his juror questionnaire.

In September of 2021, the holdout juror in the Clancy case faced a criminal charge for assaulting his wife out of Brockton District Court.

According to a police report, the juror’s 13-year-old nephew called 911 after he said his uncle grabbed his wife by the throat and threw her into a dresser.

The report says the juror’s mom repeatedly screamed, “You’re evil!” as police arrested him.

Court records show the couple divorced after the incident and the criminal charge was later dismissed.

The ex-wife told NBC10 Boston this week that she did not want to testify in the case because she was worried about losing custody of her daughter.

Last year, that same teenage nephew referenced in the 2021 incident took out a restraining order after he said the juror pushed him to the ground and repeatedly punched him in the face.

The teen wrote in his affidavit that his uncle then said, “You ruined my (expletive) life,” for calling the police and added, “You’ve had this coming your way for a long time.”

That restraining order was still active when the juror was selected for the Clancy trial and listened to evidence for weeks in the controversial case.

“I don’t see how they would’ve allowed him to be a member of this jury,” NBC10 Boston’s chief legal analyst Michael Coyne said.

The standard juror questionnaire in Massachusetts clearly asks if someone has been arrested, charged with a crime or been served with a court order. All of those boxes should have been checked by this juror.

“I don’t see how, if those questions had been answered correctly, one side or the other would’ve taken the chance with allowing him to be seated,” Coyne said.

The NBC10 Boston Investigators also learned that the holdout juror hasn’t paid the monthly rent at his home since last March, according to housing court records.

As jurors deliberated last week, the landlord secured a judgment of more than $12,000 in unpaid rent and is moving forward with an eviction, housing court records show.

When the Clancy trial ended with no verdict, several jurors described how the lone holdout refused to engage in deliberations, describing him as “arrogant” and saying he wouldn’t interact with them. One juror described the holdout juror’s behavior as “shocking.”

When the NBC10 Boston Investigators contacted the holdout juror’s family members, they said he had been estranged since the incident with his nephew. None of them knew about his involvement with the Clancy trial.

One family member described him as a “narcissist” who she believes never should have served as a juror in such an important case.

In the wake of these revelations, Coyne said he thinks the holdout juror’s questionnaire will have to be reviewed by prosecutors to see if the information the juror put down was truthful.

“It is, in fact, a crime not to do so,” he said.

NBC10 Boston has reached out to the Plymouth District Attorney’s Office to ask about our findings, along with Clancy’s defense team. Both sides declined to comment on Friday afternoon.

Juror questionnaires are not public records, so it’s unclear if the document in question still exists or if it was destroyed in the wake of the mistrial. Because of that, NBC10 Boston cannot confirm how the juror filled out the questionnaire.
