It appears there are at least five votes to strike down the Defense of Marriage Act, Pete Williams of NBC News has reported from outside the Supreme Court.
Williams added that in oral arguments Wednesday morning, Justice Anthony Kennedy, the key swing vote, said he was troubled by several aspects of the law, including that it applies even in states that allow same-sex marriage.
The law prevents same-sex couples from receiving federal benefits that straight couples get.
