The district attorney's office has cleared policeman Marcus Lehmkuhl in the fatal shooting Nov. 17 of a transient.
Lehmkuhl shot Orrin Norris during a struggle next to a convenience store. Police said Norris, who was carrying a 2-foot-long stick with a metal blade on the end, was trying to take the officer's gun.
Norris had been chasing another man when Lehmkuhl intervened.
He ordered Norris to lie down but instead he attacked, police said. Norris had a blood alcohol level of more than twice the legal limit.
